These terms govern your use of the TrekTastes apps and website. By creating an account or placing an order you agree to them.

The “In short” notes are plain-language summaries for readability only; the full policy text below each summary is what applies.

1. Who we are

In short: Arkstasis (trading as TrekTastes), a sole proprietorship in the Netherlands, KvK 42057592, runs the app and website. Our registration, VAT number and contact details are below.

Arkstasis (eenmanszaak), established in the Netherlands, Chamber of Commerce (KvK) no. 42057592, operating under the TrekTastes brand ("TrekTastes", "we"). We operate the TrekTastes apps and website (the "Platform").

Our business address is registered with the Dutch Chamber of Commerce under the KvK number above; it is available from the KvK register (kvk.nl) and from us on request. VAT (btw) identification no.: NL005462594B13.

2. What TrekTastes is (and is not)

In short: TrekTastes is only the intermediary: your purchase agreement is with the Vendor, who prepares, sells and hands over the food. Orders are pickup, delivery (by the Vendor or its courier), or dine-in.

TrekTastes is a discovery and order-ahead platform for Amsterdam's independent food scene: food festivals, street markets, food trucks, pop-ups and standalone food businesses such as local restaurants. Independent food businesses ("Vendors") list their stalls, kitchens or premises and menus; you order and pay ahead, then receive your food per the fulfilment mode offered for your order. Some Vendors trade only at events; others operate from a fixed location every day.

TrekTastes is an intermediary. Your purchase agreement is directly with the Vendor — the Vendor prepares, sells and hands over the food, and the Vendor (not TrekTastes) is the merchant of record for your payment. TrekTastes is not a party to the sale, does not prepare, own or handle any food, and does not provide delivery services.

Fulfilment modes. Depending on the event and Vendor, an order is:

  • Pickup (default) — collect at the Vendor's stall, counter or premises;
  • Delivery — where offered, delivery is performed by the Vendor or a courier engaged by the Vendor; the courier acts for the Vendor, not for TrekTastes;
  • Dine-in — where offered, served at the Vendor's seating.

Availability of modes varies per Vendor and, for event-based Vendors, per event.

3. Definitions

In short: The words we capitalise in these terms (Vendor, Order, Handover, Deal, Event, Organiser, Platform) mean what this section says.

These terms use the following defined words. Wherever they are capitalised, they carry the meaning given here.

Deal
A promotion or bundle offered by a Vendor through the Platform (see section 8).
Event
A festival, market or similar occasion at which Vendors trade.
Handover
The moment the food is given to you: at pickup, on delivery, or when served for dine-in.
Order
An order you place through the Platform.
Organiser
The party that runs an Event.
Platform
The TrekTastes apps and website.
Vendor
The independent food business that lists on and sells through the Platform. The Vendor is the seller and the merchant of record for your payment.

4. Vendors, your rights and how results are ranked

In short: Vendors are independent traders. Your food-related consumer rights are against the Vendor, not TrekTastes. Results are ranked by match, availability and distance; no one can pay for a higher ranking.

Vendors are independent traders. Each Vendor sells on its own account: your purchase agreement for the food is with the Vendor, and your consumer rights in respect of the food and its sale are against the Vendor, not against TrekTastes. This does not affect any rights you have against TrekTastes for the platform service itself (sections 16–17).

How search and listing results are ranked. Results are ranked mainly by how well a Vendor matches your location and your search terms, then by availability and opening status, and by distance. No Vendor can pay for a higher ranking and TrekTastes does not sell placement. Within an Event, listings may be curated by the Organiser.

5. Your account

In short: You must be 16 or older to have an account. Keep your details accurate and your login private. You are responsible for activity on your account.

You must be at least 16 years old to create an account, and you may only buy age-restricted items (section 12) if you meet the legal age for them. Keep your account details accurate and your login credentials confidential; you are responsible for activity on your account.

6. Orders and contract formation

In short: Your order is an offer; the contract forms when payment is confirmed. The Vendor can cancel with a full refund. Check your order at handover; the Vendor is responsible for allergen and dietary claims.

Menus, prices, portion descriptions, allergen and dietary information and availability are provided by the Vendor. Your order is an offer to the Vendor. The agreement is concluded when your payment is confirmed and the order confirmation appears in the app. The Vendor retains the right to cancel a confirmed order (e.g. stock-outs, closure), with an automatic full refund.

Check your order at handover. Please check completeness at the Vendor's stall, counter or premises, or at the door, and raise missing or incorrect items right away where possible. That is the fastest route to a fix (see section 11).

Allergens & dietary claims (e.g. vegan, halal, gluten-free) are supplied by the Vendor, who is responsible for their accuracy. If you have an allergy or strict dietary requirement, confirm with the Vendor's staff before consuming.

7. Prices, fees and payment

In short: Vendors set prices (incl. VAT). A TrekTastes service fee is shown separately before you pay. You pay by iDEAL or card via Stripe; the Vendor is the merchant of record and TrekTastes never holds your money.

Prices are set by Vendors and include VAT. Where a listed price is a manifest error (an obvious mistake a reasonable customer would recognise), the Vendor may cancel the order with a full refund. Depending on order value, a service fee applies: this is TrekTastes' own charge to you for the platform service (discovery, order-ahead and order handling), shown as a separate line at checkout before you pay and included in the total. You pay in the app by iDEAL or card. Payments are processed by Stripe on behalf of the Vendor (the Vendor is merchant of record; your statement shows the Vendor's name). TrekTastes does not hold your money at any point. Technical errors and manipulation: refunds are limited to the amount you actually paid and that was successfully settled. We use our transaction records and those of our payment processor to establish what was actually paid; you may always show that those records are incorrect. If a price, fee, total or balance is shown or processed incorrectly because of a technical fault, a display bug, or any manipulation or tampering, the order may be cancelled or corrected, and no refund, credit or payment is owed on an amount that was not genuinely paid or that resulted from the error or manipulation. Deliberately exploiting such a fault, or interfering with pricing or payment, is a breach (section 14).

8. TrekTastes Deals

In short: Deals are the Vendor's promotions, offered, priced and honoured by them. Surprise-style bundles vary in contents. If a paid Deal can't be honoured you get a full refund. Deals don't stack unless the Vendor says so.

Vendors may offer promotions or deal bundles through the Platform ("Deals"). Deals are offered, priced and honoured by the Vendor, subject to the conditions shown in the app (validity window, quantity limits, "while stocks last"). Where a Deal is a variable/surprise-style bundle, its exact contents are determined by the Vendor within the description shown — contents vary by nature. Deal availability may end when the Vendor's stock runs out; if a paid Deal cannot be honoured, you receive a full refund. Deals cannot be combined with other offers or promotions unless the Vendor states otherwise.

9. No right of withdrawal

In short: Because food is perishable and made for you, there's no 14-day cooling-off right (art. 6:230p BW). Cancellations and complaints are covered in sections 10–11.

Because meals and fresh food are perishable and prepared for you, the statutory right of withdrawal for distance purchases does not apply (art. 6:230p BW, mirroring Directive 2011/83/EU exceptions for perishable goods and hygiene-sealed items). Cancellation and remedies are governed by sections 10–11.

10. Cancellations, event changes and uncollected orders

In short: Cancel free until the Vendor starts preparing. Vendor cancellations, organiser cancellations, and reschedules/relocations get a full refund. No refund if you're a no-show or gave a wrong address; refund if the failure is the Vendor's. An order isn't event admission.
  • You can cancel free of charge until the Vendor starts preparing your order (order shows pending/confirmed). We reserve the right to introduce preparation-stage-dependent fees with advance notice.
  • Vendor cancellation (stock-out, closure, or absence from a scheduled event): automatic full refund (section 6).
  • Event cancelled by the organiser (event-based orders): your orders are cancelled automatically and refunded in full.
  • Event rescheduled, or your stall or pitch relocated within the venue (event-based orders): your affected orders are treated as cancelled with a full refund, unless you choose to keep the order for the new time or location.
  • No-show / failed handover: if you do not collect during the pickup window, or delivery fails because you are unreachable or provided a wrong address, no refund is due for this customer-caused failure. Where a failed handover is the Vendor's fault, you are refunded in full.
  • Admission is your responsibility (event-based orders): some events require a ticket or entry fee. Buying a TrekTastes order does not grant event admission, and being unable or unwilling to enter the event does not create a refund right.

11. Missing items, quality and other complaints (remedies)

In short: Report missing/incorrect items or quality problems within 24 hours with evidence. The Vendor owes the remedy: replacement or a partial/full refund to your original payment method. Food-safety issues: report immediately; your statutory rights are unaffected.
  • Missing or incorrect items: report in the app or to support@trektastes.com within 24 hours of handover (at the Vendor's stall, counter or premises, raise it immediately where possible). We may ask for a photo and your order number.
  • Quality, freshness, quantity or temperature complaints (spoiled, undercooked, portion materially below description, unsafe): report within the same window with reasonable evidence.
  • Remedies are owed by the Vendor as seller: replacement at the Vendor's stall, counter or premises where practical, or a partial or full refund. Refunds (here and under section 10) go to your original payment method by default; in suspected-fraud cases the refund may be made to a card instead. TrekTastes facilitates the process and may issue the refund on the Vendor's behalf.
  • Food-safety incidents (suspected food poisoning, foreign objects, allergen reactions): report immediately; we will connect you with the Vendor, who is responsible for the food, and cooperate with authorities (NVWA) where required. Nothing in these terms limits your statutory rights or the Vendor's liability for unsafe food.
  • Your statutory warranty rights (conformity, art. 7:17 BW) against the Vendor remain unaffected.

Refunds — timing and funding. Refunds due are issued to your original payment method without undue delay, and at the latest within 14 days of the cancellation or, for complaints, of the refund decision; how long they then take to appear depends on your bank or card provider. The Vendor is the seller and merchant of record and is responsible for funding all refunds and remedies for your order. TrekTastes does not hold your payment, is not the seller, and does not guarantee the Vendor's refunds; it facilitates refunds on the Vendor's behalf from the Vendor's payment account. Where a refund due to you cannot be collected from the Vendor, your claim for that amount is against the Vendor, and you may also request a chargeback from your bank or card provider — your statutory consumer rights are unaffected. TrekTastes may advance a refund at its discretion and recover it from the Vendor, but is not obliged to fund the Vendor's obligations from its own resources, except where the shortfall results from a TrekTastes platform failure (section 16).

12. Alcohol and age-restricted items

In short: Age-restricted items (like alcohol) need age checks, done by the Vendor or its courier at every handover. No valid ID, no handover, and no refund for the age-restricted items if verification fails — unless the refusal wasn’t your fault.

Items with legal age restrictions (e.g. alcohol, 18+) may only be sold and handed to persons meeting the legal age. Age verification is the Vendor's responsibility at every handover:

  • at pickup, the Vendor's staff verify age (NIX18) and may require ID;
  • at delivery, the Vendor's courier performs the same verification at the door as part of the Vendor's responsibility: no ID, no handover;
  • at dine-in, the Vendor's staff verify age before serving age-restricted items;
  • the Vendor may also refuse sale, service or handover to visibly intoxicated persons (Alcoholwet).

If handover is refused because your age could not be verified, no refund is due for the age-restricted items, consistent with a customer-caused failure, unless the refusal was not attributable to you (for example, valid ID was wrongly rejected), in which case those items are refunded in full.

13. Delivery and pickup: practical rules

In short: Risk passes to you at handover. Times are estimates, with no guaranteed wait. Whoever shows your order number/QR can collect, so keep it private. For delivery, you provide a correct address and stay reachable.
  • Handover completes the sale: risk in the food passes to you at handover (stall, counter, premises or door).
  • Delivery and pickup times are estimates; busy periods can cause short waits. Order-ahead reduces queueing but no specific wait time is guaranteed.
  • Whoever presents your order number/QR at handover is treated as authorised to receive the order — keep it private.
  • For delivery: you are responsible for a correct address/location pin and for being reachable; the Vendor (and its courier) is responsible for transport care and food-safe handling in transit.
  • Delivery may be limited to a delivery area set by the Vendor, such as the event grounds or a neighbourhood radius.

14. Acceptable use; suspension

In short: Don't commit fraud, scrape, abuse people, or misuse cancellations. We can suspend accounts that do. We'll state a reason where possible, and suspension never keeps your paid, undelivered orders (those get refunded). You can also report illegal content to us.

No fraudulent orders or payments, no scraping or interfering with the service, no exploiting technical faults and no manipulating prices, totals or payments, no abusive behaviour toward Vendors, couriers or staff, no unlawful use. We may suspend or block accounts that break these rules — including for payment fraud, chargeback abuse, harassment, or systematic misuse of cancellations or complaints. Where reasonably possible we state the reason, and you can object via support@trektastes.com. Suspension never confiscates paid, undelivered orders: they are cancelled and refunded per section 10. An automated cancellation velocity guard may temporarily block excessive cancellations (see Privacy Policy §3).

Reporting illegal content. If you consider that content on the Platform (for example a Vendor listing, menu, image or Deal) is illegal or breaches these terms, email support@trektastes.com with: a link or description of exactly where the content is, why you consider it illegal or in breach, your name and email address, and a statement that your report is made in good faith. We confirm receipt, review reports and act where required (including removing content or restricting an account), and give you and, where applicable, the affected Vendor a reasoned decision. You can object to a decision by replying to it.

15. Events, availability and force majeure

In short: Events can change, and we don't guarantee the app is always up. Neither the Vendor nor TrekTastes is liable for things beyond reasonable control (weather, evacuations, closures), but your section 10 refund rights still stand.

Events, opening hours, availability and line-ups are set by Vendors and, for events, by organisers, and can change. The Platform is provided with reasonable care, without guarantee of uninterrupted availability. Force majeure: neither the Vendor nor TrekTastes is liable for failure caused by circumstances beyond reasonable control — e.g. severe weather, evacuations, safety or regulatory closures, power or network failure at the venue — though your refund rights under section 10 (cancelled orders/events) remain.

16. Liability

In short: The Vendor is responsible for the food and its sale. TrekTastes' own liability is capped at the higher of your service fees over the past 12 months or €100, except where the law says otherwise or for intent/gross negligence. If a platform failure loses your paid order, we make you whole.

Nothing in these terms limits liability that cannot be limited by law or your mandatory consumer rights. The Vendor is responsible for the food and its sale: safety, hygiene, quality, freshness, quantity/completeness, allergen and dietary accuracy, Deal fulfilment, age verification, and — for delivery orders — the acts of its couriers.

For the Platform itself, and except where mandatory law provides otherwise or in cases of intent or gross negligence, TrekTastes' total liability per event giving rise to damage is limited to the higher of (a) the service fees you paid to TrekTastes in the 12 months before that event and (b) €100. TrekTastes remains responsible for its own platform failures (e.g. an order that was paid but never transmitted to the Vendor) — in that case you are at minimum made whole for the affected order.

17. Complaints about TrekTastes

In short: For complaints about TrekTastes itself, email support@trektastes.com. We aim to reply within 5 working days. Food complaints go through section 11. We are not signed up to an ADR body; you can still go to court.

TrekTastes has not committed to, and is not required to use, an alternative dispute resolution (ADR) body for consumer disputes; your right to bring a dispute before the competent court (section 20) is unaffected.

18. Privacy

In short: Our Privacy Policy explains what we do with your data. Your order details go to the Vendor (and its courier for delivery) to fulfil your order.

19. Changes to these terms; acceptance records

In short: We'll announce material changes at least 15 days ahead; you can reject by closing your account before they start. Keep using TrekTastes and you accept the new terms; we record your acceptance per version.

Material changes are announced at least 15 days in advance; you may reject a change by stopping use or closing your account before it takes effect. Continued use after that constitutes acceptance; acceptance is recorded server-side per user and version.

20. Governing law and forum

In short: Dutch law applies and the Amsterdam court is competent, but mandatory consumer rules may still let you sue where you live.
