These terms govern your use of the TrekTastes Vendor Platform as a food business. They form the B2B agreement between you and Arkstasis, trading as TrekTastes. Customers are covered by our separate Customer Terms and Privacy Policy.

1. Parties and scope

In short: The B2B agreement between your food business and Arkstasis (trading as TrekTastes). You must be a registered business; customers have separate terms.

These terms govern use of the TrekTastes Vendor Platform by food businesses ("Vendor", "you") and form the agreement between you and Arkstasis (eenmanszaak), Amsterdam, KvK no. 42057592, operating under the TrekTastes brand. You must be a business registered with the Dutch Chamber of Commerce or an equivalent EU business register. Customers are covered by our separate Customer Terms and Privacy Policy.

2. The service

In short: TrekTastes is the intermediary; you're the merchant of record and sell directly to the customer. You choose pickup, delivery or dine-in per event — any delivery is by you or your own courier.

TrekTastes lists your stall and menu at participating events, gives you an order-ahead sales channel, and a live order queue on your own device. It is an intermediation service in the sense of the P2B Regulation: sales contracts are concluded directly between you and the customer — you are the merchant of record. Orders are confirmed automatically on successful customer payment; you keep a cancellation right with an automatic full customer refund.

Fulfilment modes. You choose which modes you offer per event: pickup, delivery or dine-in. TrekTastes operates no courier network and provides no delivery services — where you offer delivery, it is performed by you or a courier engaged by you, acting solely for you (see section 5).

3. Payments — your own Stripe account

In short: You sell through your own Stripe account (you're the merchant of record). TrekTastes' only commission is a flat €0.59 per order — never a percentage — plus the customer-paid service fee. You handle chargebacks, authorise policy-based refunds, and keep enough balance to cover them.
  • You must create and maintain your own Stripe account during onboarding and accept the Stripe Services Agreement directly with Stripe. Stripe performs its own KYC and verification on you; your listing goes live only when your Stripe account is ready.
  • Customer payments (iDEAL, Wero and cards) are direct charges to your Stripe account — you are the merchant of record, and TrekTastes never holds customer funds.
  • Platform fees: a vendor commission of a flat €0.59 per transaction — a fixed fee, never a percentage of your sale — plus the customer-paid service fee (tiered by order value: €0.29 under €7; €0.49 for €7–15; €0.99 up to €25; €1.49 up to €39.99; €1.99 up to €59.99; €2.49 up to €99.99; €3.90 up to €149.99; 3.5% at €150 and above), collected by TrekTastes. Both are collected automatically via the Stripe application fee on each direct charge.
  • Payouts to your bank account follow Stripe's payout schedule for your account. Chargebacks and payment disputes on your charges are your responsibility as merchant of record; TrekTastes monitors disputes on the platform, tracks them per order, and provides evidence and reasonable assistance.
  • Standing refund authorisation. You authorise TrekTastes to initiate refunds (full or partial) on charges made through the Platform, on your Stripe account, in the cases defined by these terms and the published refund policy: customer cancellations, vendor cancellations, organiser cancellations, upheld complaints (missing or incorrect items, quality), unhonoured Deals, price-difference remedies (section 5), and age-verification refusals. You may contest a refund afterwards through the complaints route (section 8) — but refunds are executed first to protect customers.
  • Keep the connection and cover your balance. You must (a) keep the Stripe–TrekTastes Connect authorisation active until all orders taken through the Platform are fulfilled, refunded or otherwise settled, plus 30 days; and (b) maintain a balance or linked bank account sufficient to cover refunds reasonably expected on open orders. Revoking the Connect authorisation or emptying the account while customer-facing obligations are outstanding is a material breach (section 7) and makes all such amounts an immediately payable debt to TrekTastes.

4. Taxes and DAC7 reporting

In short: You handle your own VAT and receipts. TrekTastes must report your seller details and totals to the Dutch tax authority under DAC7 — providing that information is required to use the Platform.

You are responsible for your own VAT and tax obligations, including issuing receipts where required. As a digital platform operator, TrekTastes is required under DAC7 (Directive 2021/514, implemented in Dutch law) to collect, verify and report seller information (identity, KvK/VAT numbers, account identifiers and transaction totals) to the Belastingdienst annually. Providing this information is a condition of using the Platform.

5. Your responsibilities

In short: You own everything about the food and the sale: accurate listings and allergen/dietary claims; app prices must match your stall prices (a mismatch means a refund to the customer and compensation to us); food safety, quality and completeness; honouring orders and Deals; resolving complaints; age checks at every handover; adequate insurance; and a licence for us to show your listing.

Food, listings and fulfilment.

  • Listing accuracy: your business, menu, prices, portion descriptions, and allergen and dietary claims (vegan, halal, gluten-free, etc.) — you are responsible for their accuracy and for answering customer allergen questions at handover.
  • Price parity: the prices you list in the app must match the prices you charge at your stall or store for the same items. If a price difference is found — whether reported by the customer or identified by TrekTastes — the customer is entitled to the difference on their order, and TrekTastes is entitled to compensation from you for the discrepancy (section 7).
  • Food safety and quality: hygiene compliance (HACCP, NVWA requirements, event-site rules) and the safety, quality, freshness, temperature control and quantity/completeness of every order — from preparation through handover, including transport on delivery orders.
  • Honouring orders: confirmed orders, pickup windows and Deals must be honoured; cancel promptly (with an automatic full refund) when you cannot fulfil.
  • Complaints and remedies: resolve missing-item, incorrect-item and quality complaints raised within the customer complaint window (24 hours) within 48 hours; remedies (replacement, partial or full refund) are yours to bear as seller. TrekTastes may process the refund on your behalf via your Stripe account per the published refund policy.
  • Recalls and incidents: comply with food-recall obligations and tell us immediately of any food-safety incident linked to a platform order.

TrekTastes Deals. Deals you publish are your offer — you set the content, price and conditions, and you fund and honour them. Variable or surprise-style Deals must match their published description in kind and minimum value. Deals that cannot be honoured are cancelled with a full customer refund at your cost.

Delivery by your couriers. Where you offer delivery, the courier — whether your staff or a third party you engage — acts for you, not for TrekTastes. You are responsible for their engagement terms (employment/contractor status, wages, insurance), their conduct and traffic-law compliance, food-safe transport, correct handover, and age verification at the door for age-restricted items (NIX18/Alcoholwet) — no valid ID, no handover. Delivery zones and times you publish are your commitments.

Age-restricted items. You verify legal age (18+ for alcohol) at every handover — stall pickup and courier delivery alike — and may refuse sale or handover to underage or visibly intoxicated persons. You are responsible for holding or operating under the required alcohol licence at each event.

Prohibited items. No sale of items that are unlawful, subject to a recall, outside your licence coverage, or prohibited by the event organiser. We may delist such items and suspend the listing (section 7).

Insurance and your content. You must hold and maintain adequate business and product liability insurance covering your food sales and (where you deliver) your couriers, and provide evidence on request. You grant TrekTastes a non-exclusive, royalty-free licence to display your business name, logo, menus, photos and descriptions on the Platform and in event listings for the duration of the agreement. You warrant your content is accurate and does not infringe third-party rights (including photo rights) and indemnify us for claims arising from it (section 11).

6. Ranking

In short: Your placement comes from a composite ranking score, the customer's own filters, and the organiser's featured order within a festival. There is no paid placement.

Stall and event ordering is determined by: (a) a server-computed composite ranking score per vendor; (b) user-chosen filters and context (distance, open/closed status, category); and (c) within a festival page, the organiser-curated featured order. No paid ranking or paid placement exists. If paid placement is ever introduced, it will be disclosed here and marked in the interface.

7. Restriction, suspension, termination and enforcement

In short: We can suspend or terminate for legitimate reasons (with a stated reason, and 30 days' notice to terminate), and open orders are refunded at your cost. If your breach — including a price mismatch — costs us or a customer, you reimburse it plus our published compensation schedule; we can recover via Stripe, set-off, or a deposit for new vendors.

Suspension and blocking. We may restrict, suspend or block your listing or account for legitimate reasons, including: food-safety risk or incident; fraud or payment abuse; materially inaccurate listings (including allergen/dietary claims, or prices that do not match your stall); repeated upheld customer complaints; failure to honour orders or Deals; breach of the age-verification duties; prohibited items; unpaid amounts under this section; revoking the Stripe Connect authorisation contrary to section 3; or legal requirements. We provide a statement of reasons on or before the effective moment. Termination by TrekTastes requires 30 days' prior notice with reasons, except where law requires otherwise or repeated infringement is manifest. On suspension or termination, open orders are cancelled and refunded at your cost.

Compensation for violations. Where your breach of these terms causes customer remedies, refunds, chargeback costs, regulatory exposure or platform damage — including price discrepancies, food-service, fulfilment, delivery, freshness, quality, Deals or age-verification failures — you owe TrekTastes: (a) reimbursement of all refunds and remedies TrekTastes funded or executed on your behalf, including price-difference refunds to customers; and (b) the costs set out in our published fee and compensation schedule.

Recovery. Amounts owed are payable within 14 days of invoice. TrekTastes may recover them by initiating refunds or reversals on your Stripe account where the Connect authorisation permits, by set-off against any amount TrekTastes owes you, and by invoicing; and, for new or elevated-risk vendors, we may require a security deposit or bank guarantee. Taking payment without fulfilment remains your sole liability as merchant of record — TrekTastes may refund affected customers as a goodwill measure and recover the full amount from you. You can terminate at any time with 30 days' notice.

8. Complaints and mediation

In short: Vendor complaints go to support@trektastes.com; we aim to respond within 5 working days.

9. Data protection

In short: A separate Data Processing Agreement covers order-data roles; your own vendor-account data is covered by the Vendor Privacy Policy.

Data-protection roles are allocated in the Data Processing Agreement (a separate document provided at onboarding): you and TrekTastes act as independent controllers for customer order data, and TrekTastes processes your operational data as processor where applicable. How we handle your own vendor-account data is described in the Vendor Privacy Policy.

10. Changes to these terms; acceptance records

In short: We give at least 15 days' notice of changes; you can terminate before they take effect. Continued use is acceptance, recorded per version.

11. Liability; term; law

In short: Our liability to you is capped at the fees we earned from you in the prior 12 months (and, per order, the net fees on that order), except for intent/gross negligence or where the law says otherwise. You indemnify us for claims arising from your food, listings, Deals and couriers. Dutch law, Amsterdam court.

Fees as consideration. The vendor commission and the customer service fee are TrekTastes' consideration for the intermediation service. TrekTastes invoices its fees with VAT as required.

Platform liability cap (B2B). Except in cases of intent or gross negligence, or where mandatory law provides otherwise, TrekTastes' aggregate liability to you is capped at the platform fees TrekTastes earned from you in the 12 months preceding the event giving rise to the claim; and for claims relating to a single order, TrekTastes' liability will not exceed the net fees TrekTastes earned on that order.

Vendor indemnity. You indemnify TrekTastes against third-party claims arising from your food, your listings (including allergen and dietary accuracy), your Deals, your couriers, and your breach of law.

Neither party's liability is limited for death or personal injury caused by its fault. Dutch law applies; the competent court is Amsterdam.
